A sweeping federal antitrust lawsuit is moving forward against MultiPlan, Inc. and several major insurers — including Aetna, Cigna, UnitedHealth, and Blue Cross Blue Shield — alleging that MultiPlan, using services marketed under names such as Data iSight, Viant, NCN, ProPricer, and MARS, facilitated a horizontal price-fixing agreement among insurers that artificially suppressed out-of-network payment rates and cost providers billions of dollars.

Following a key court ruling in June, the case is headed into discovery, with potential damages tripled under federal law for successful claims. The court has also appointed attorneys to litigate a proposed antitrust class action on the same issues, though a ruling on class certification is not expected until 2027. Importantly, practitioners who believe they have been impacted by MultiPlan’s conduct can join the litigation individually on a non-class basis and do not need to wait for any ruling on a proposed class.
